To Enter: There are two ways to enter: i) An eligible Visa Debit client will automatically be entered for one chance to win each time she/he makes a payment to Eastlink either online or by phone with Canadian-issued Visa Debit between September 1, 2012 at 12:00:01 a.m. Eastern Time (ET) and November 30, 2012 at 11:59:59 p.m. ET (the “Contest Period”) that is posted to her/his account by December 7, 2012 (a “Qualifying Payment”) up to a maximum of three (3) entries. Transactions made during the Contest Period but not posted to the applicable bank account by December 7, 2012, shall not be considered to be a Qualifying Payment. The following are also excluded from being eligible for entry: a) payments made by an unauthorized user; and b) payments made with a Visa Debit number which has been stolen, is fraudulent, has been tampered with, or otherwise altered. ii) NO PURCHASE REQUIRED: To enter without payment or obligation, Visa Debit clients must hand-print the date, their name, address, city, province or territory, postal code, day and evening telephone numbers, the first 8 digits of their Visa Debit number, the words “The Visa Debit ‘Win your Bill for a Year’ at Eastlink Contest” on a 3” x 5” card, include a 100-word or more handwritten original essay on the “Value of using Visa Debit”, and mail in a postage stamped envelope to: The Visa Debit “Win your Bill for a Year” at Eastlink Contest, 49 Ontario Street, Suite 301, Toronto, Ontario, M5A 2V1. Maximum of one non-purchase entry per envelope with sufficient postage. Non-purchase entries must be postmarked by the last day of the Contest Period, and only those received by December 7, 2012 will be included in the draw. No mechanical reproductions permitted. Maximum of three (3) entries into the contest, regardless of method of entry. Entries become the property of Visa Canada Corporation (“the Sponsor”) and will not be returned.
Prizes: There are two (2) prizes (the “Prizes”) available to be won. Each Prize consists of $2,500 CAD, awarded as a credit to the applicable winner’s Eastlink account. Prize value was determined based on the cost of an Eastlink premium TV, internet and home phone package for twelve (12) months, including applicable taxes. Prizes must be accepted as awarded and are not transferable or convertible to cash. No substitutions except at Sponsor’s option. Sponsor reserves the right, in its sole discretion, to substitute a Prize or a component thereof with a prize of equal or greater value.
Drawing: On December 17, 2012 at 1:00 P.M. Eastern Time (ET) in Toronto, Ontario, two (2) potential winners and two (2) potential alternate winners will be drawn at random from among all eligible automatic entries and all eligible non-purchase entries received during the Contest Period.
Eligibility: To be eligible to win the prize, an entrant must: a) be a Canadian resident; b) be a Visa Debit client with a Visa Canada licensed Financial Institution (“FI”) at the time of entry whose account is open at the time of verification by the cardholder’s FI; c) have reached the age of majority in the province or territory in which she/he resides as of September 1, 2012 and; d) not be an employee of, or living with an employee of the Sponsor or its affiliates, the Sponsor-licensed financial institutions, the Sponsor’s advertising or promotional agencies, the contest administrator, or the independent contest judging organization. There is no fee to become a Visa Debit client. More details on available Visa Debit products can be found at www.visa.ca. Contest is void where prohibited or restricted by law. The Contest is subject to all applicable federal, provincial, and local laws and regulations.
Odds: The odds of winning a prize depend on the total number of eligible automatic entries and eligible non-purchase entries received throughout the Contest Period.
Use of Information: By using Visa Debit to make a Qualifying Payment during the Contest Period, Visa Debit clients agree to being automatically entered into the Contest. If selected as a potential winner for the Contest, it will be necessary for the Sponsor to contact the potential winner’s Visa Debit-issuing financial institution to award the prize. No permanent records of any such personal information will be retained by such parties, except for the administration of this Contest as set out in Section 7 of these Official Contest Rules. If a Visa Debit client does not want to be automatically entered into the Contest, they must call 1-888-242-5550 prior to the end of the Contest Period and their Qualifying Payments will not be entered into this Contest.
Winner Notification/Prize Awards: The following process will be followed for the Contest. Each selected entrant will be notified via courier or in person by the independent contest judging organization. In order to win the Prize, a selected entrant must correctly answer, unaided, a time-limited, arithmetical, skill-testing question and sign and return the Sponsor’s standard declaration and release form (the “Sponsor Release”) within twenty-one (21) days from the time the prize notification is postmarked as having been sent by the independent contest judging organization. The skill-testing question and the Sponsor Release will be included in the prize notification package from the independent contest judging organization. A non-responding selected entrant will be notified by phone at the two (2) primary telephone numbers (as indicated on their Visa Debit profile records maintained on their FI’s system or as shown on their non-purchase entry) between the 11th and 14th and 17th and 20th days following the initial notification. No messages will be left and the independent contest judging organization must speak directly to the selected entrant. The prize will be forfeited and available to be awarded to an alternate winner following the procedures set forth above if: (a) the prize notification is returned as non-deliverable and telephone contact is not established; (b) if the Sponsor Release, including skill testing question, is not returned within twenty-one (21) days from the time the prize notification package is postmarked as having been sent by the independent contest judging organization; or (c) if the skill-testing question is incorrectly answered. In the event the prize notification package is returned as non-deliverable from the alternate winner, the alternate winner does not return the required documentation within twenty-one (21) days, and/or the skill-testing question has been incorrectly answered by the alternate winner, the prize will be forfeited and not awarded to any further alternates.
Additional Terms: By participating, all entrants agree to: (a) these Official Rules and the decisions of any of the contest administrator, independent contest judging organization, and the Sponsor that shall be final and binding without right of appeal in all respects; and (b) release, discharge, indemnify and hold harmless the Sponsor and its affiliates, Sponsor-licensed financial institutions, the Sponsor’s advertising or promotional agencies or any independent contest judging organization, and any of the foregoing entity’s respective officers, directors, affiliates, related entities, partners, partnerships, principals, representatives, agents, licensees, employees, vendors, successors and assigns (collectively the “Contest Parties”) from any liability, claims, or damages, demands, actions, or causes of action whatsoever which they, their heirs, successors, assigns, executors, or administrators may now or hereafter have directly or indirectly against them or any of them in respect of or relating to the Contest, an entrant’s participation in the Contest, and/or the acceptance or use, misuse, or possession of the prize. By accepting the prize, the winner agrees to the Sponsor’s and its designee’s use of his/her name, city, province or territory of residence and/or photograph or other likeness for advertising and publicity purposes without notice or compensation. All national, provincial and local laws and regulations apply.
Limitation of Liability: The Contest Parties shall not be responsible for print or typographical errors in the offer or administration of the Contest or any other Contest-related materials; for stolen, lost, late, misdirected, damaged, incomplete, illegible, or postage-due no-purchase entries; or for or for transactions that are posted late or incorrectly or are lost due to computer or electronic malfunction. The Sponsor reserves the right, subject to the approval of the Régie des alcools, des courses et des jeux du Québec, to cancel or modify the Contest if fraud or technical failures compromise the integrity of the Contest as determined by the Sponsor in their sole discretion.
For Québec Residents Only: Any litigation respecting the conduct or organization of a publicity contest may be submitted to the Régie des alcools, des courses et des jeux du Québec for a ruling. Any litigation respecting the awarding of the Prize may be submitted to the Régie only for the purpose of helping the parties reach a settlement.
